OFFICIALLY PROHIBITED: LIVESTREAMING COURT HEARINGS AND SESSIONS FROM AUGUST 1, 2026
I. Legal basis

II. Is livestreaming court hearings and court sessions Prohibited from august 1, 2026?
Pursuant to clauses 4 and 12, Article 4 of Circular No. 12/2026/TT-TANDTC, the following provisions apply:
Participants and attendees at court hearings and court sessions are not permitted to livestream or broadcast them online; provide false information; provide information that affects the independence of the courts or the requirement to adjudicate and resolve cases independently, impartially, and objectively in accordance with the law; violate the human rights of defendants, victims, litigants, or other participants in legal proceedings; or violate statutory confidentiality requirements.
Under Clause 30, Article 3 of Decree No. 147/2024/ND-CP, livestreaming is defined as a feature that allows accounts on social networks or digital platforms serving electronic transactions to transmit content and data in the form of audio and images in real time.
Based on the above provisions, effective August 1, 2026, participants and attendees at court hearings and court sessions are strictly prohibited from livestreaming or broadcasting the proceedings in real time.

III. Which audio and video recording activities are permitted?
In addition, clause 4, Article 4 of Circular No. 12/2026/TT-TANDTC issued by the Supreme People’s Court provides that the following audio and video recording activities require the consent of the Presiding Judge or the person presiding over the court session:
- Recording spoken words during the court hearing or court session;
- Recording images of the Trial Panel and the Judge during the opening of the court hearing or court session, and during the delivery of the judgment or announcement of the decision.
- Where audio or video recordings are made of other judicial officers, participants in the court hearing or court session, their consent as well as the consent of the Presiding Judge or the person presiding over the court session is required.
Penalties: Depending on the nature and severity of the violation, violators may be prohibited from entering or required to leave the court hearing, subject to administrative penalties or administrative detention, or even referred for criminal prosecution, in accordance with Circular No. 12/2026/TT-TANDTC.
IV. Conclusion
Effective August 1, 2026, participants and attendees at court hearings and court sessions are not permitted to livestream or broadcast the proceedings in real time in any form.
However, audio and video recording are not completely prohibited. In certain circumstances, prior consent must be obtained from the Presiding Judge or the person presiding over the court session and/or the person being recorded, as applicable. Accordingly, individuals should comply with the applicable requirements when using audio or video recording devices at court hearings and court sessions to avoid being required to leave the courtroom, being subject to penalties, or facing other measures prescribed by law.
