From 29 April 2026, the Ministry of Science and Technology issued Official Dispatch No. 2766/BKHCN-TTCNTT, together with the Guidelines on the Use of Artificial Intelligence (AI) in the Review of Legal Normative Documents. These guidelines have a direct impact on how state authorities, organizations, and individuals apply AI technology in legal and regulatory affairs.

II. Regulations prohibiting the use of AI to automatically reach legal conclusions during legal document review

Section III of the Guidelines provides that AI is intended to serve solely as a tool for analysis, synthesis, risk identification, and recommendation, and must not replace the review, assessment, and legal determination of the competent authority. In particular, AI must not be used to automatically reach legal conclusions having determinative legal effect.

In addition, the Ministry of Science and Technology requires that all outputs generated by AI be traceable, verifiable, and capable of being cross-checked against the relevant legal basis. 

Notably, the Guidelines further emphasize that the use of AI is intended solely as a supporting tool and does not replace the responsibility of the competent authority, organization, or individual. Users remain responsible for the final decision and are required to ensure that all material decisions are subject to appropriate human oversight.

In addition, the Ministry of Science and Technology notes that AI may generate a large volume of outputs that are professionally presented and highly persuasive. Nevertheless, all such outputs must be reviewed, evaluated, and verified before being officially relied upon in the review of legal normative documents.

III. Conclusion

The application of Artificial Intelligence (AI) in the review of legal normative documents offers significant benefits by assisting in legal analysis, synthesis, and the identification of legal issues. However, AI serves solely as a supporting tool and must not be used to automatically reach legal conclusions having determinative legal effect. All AI-generated outputs must be reviewed, verified, and cross-checked against the relevant legal basis, and remain subject to human assessment and validation before being officially relied upon. Furthermore, state authorities, organizations, and individuals utilizing AI remain fully responsible for the final decision and may not substitute their legal responsibility with AI-generated outputs. Accordingly, when deploying AI in legal and regulatory affairs, appropriate governance and human oversight mechanisms should be established to ensure accuracy, transparency, and compliance with applicable laws.
