II. From 1 July 2026, physicians who disclose the sex of a fetus for the purpose of sex-selective abortion shall be subject to suspension from practice

Pursuant to Article 6 of the Law on Population 2025, No. 113/2025/QH15, the following prohibited acts are prescribed:

• Disseminating, publicizing, or providing information containing false or distorted content regarding the Party’s guidelines and policies, and the State’s policies and laws on population matters;
• Obstructing activities of communication, education, advocacy, dissemination of information, counselling on population and family planning, and access to population services.
• Sex selection of fetuses in any form; disclosure or communication of fetal sex, except in cases prescribed by the Minister of Health for the purpose of diagnosis and treatment of sex-related diseases;
• Coercion or compulsion with respect to childbirth or non-childbirth;
• Stigmatization or discrimination in access to population-related services;
• Human cloning.

In addition, pursuant to Article 15 of the Law on Population 2025, No. 113/2025/QH15, the reduction of sex imbalance at birth is prescribed as follows:

• Encouraging the inclusion of provisions promoting gender equality and discouraging sex selection at birth in community conventions and codes of conduct;
• Suspension of medical practice for individuals who disclose or communicate fetal sex for the purpose of abortion, with such suspension carried out in accordance with the laws on medical examination and treatment;
• Annually, the central statistical authority shall publish data on the status of sex imbalance at birth, serving as a basis for the Government and provincial-level local authorities to formulate and implement appropriate intervention measures.

Accordingly, in order to reduce sex imbalance, the Law strictly prohibits sex selection of fetuses in any form. In this regard, any individual who discloses or communicates the sex of a fetus for the purpose of abortion shall be subject to suspension from medical examination and treatment practice. Furthermore, on an annual basis, the central statistical authority shall publish data on the status of sex imbalance at birth, serving as a basis for the Government and provincial-level local authorities to formulate and implement appropriate intervention measures.

III. Regulations on the revocation of medical practice licenses for medical examination and treatment

Pursuant to Article 35 of the Law on Medical Examination and Treatment 2023, specific provisions on the revocation of medical practice licenses are prescribed as follows:

• A medical practice license shall be revoked in the following cases:
  • Application dossiers for issuance of a medical practice license are not in compliance with regulatory requirements;
  • Falsification of documents included in the application dossier for issuance of a medical practice license;
  • Incorrect issuance of professional title or scope of practice in the medical practice license compared with the application dossier;
  • The practitioner does not engage in medical practice for a continuous period of 24 months, except in cases of participation in a specialized training program.
  • The practitioner falls under one of the cases prohibited from practising as prescribed in Clauses 1, 2, 3, 4 and 6, Article 20 of the Law on Medical Examination and Treatment 2023;
  • The practitioner is determined by the Professional Council as prescribed in Article 101 of the Law on Medical Examination and Treatment 2023 to have committed professional or technical errors of such severity as to warrant revocation of the medical practice license;
  • The practitioner, for a second time, is determined by the Professional Council as prescribed in Article 101 of the Law on Medical Examination and Treatment 2023 to have committed professional or technical errors of such severity as to warrant suspension from practice during the validity term of the medical practice license.
  • The practitioner, for a second time, is determined by the competent state authority to have committed professional ethical violations of such severity as to warrant suspension from practice during the validity term of the medical practice license;
  • The practitioner voluntarily requests the revocation of the medical practice license;
  • Other cases as prescribed by the Government after reporting to the Standing Committee of the National Assembly.

• After a medical practice license has been revoked, if the practitioner wishes to continue practicing, he or she shall apply for a new medical practice license in accordance with Point c, Clause 1, Article 30 of the Law on Medical Examination and Treatment 2023, or apply for re-issuance of the medical practice license in accordance with Point c, Clause 1, Article 31 of the Law on Medical Examination and Treatment 2023.
