PROCEDURES FOR REGISTRATION FOR KOREA MARRIAGE IN VIETNAM

I. Regulations on marriage with foreign elements in Vietnam
1. Legal regulations:
According to Article 126 of the Law on Marriage and Family 2014
“1. For marriages between Vietnamese citizens and foreigners, each party shall comply with his/her country’s law on marriage conditions; if their marriage is conducted at a competent Vietnamese state agency, the foreigner shall also comply with this Law’s provisions on marriage conditions.
2. Marriages between foreigners permanently residing in Vietnam at competent Vietnamese agencies must comply with this Law’s provisions on marriage conditions”.
⇒ Thus, when a Vietnamese gets married to a Korean in Vietnam, each party must meet the following conditions:
- Each party shall comply with his/her country’s law on marriage conditions.
- Koreans must meet the conditions for marriage as prescribed by Vietnamese law and Korean law.

Note: Documents of Korean citizens issued by competent authorities of Korea must be consular legalized and translated and notarized.
II. Procedures for applying for marriage registration with a Korean in Vietnam
Place of application: District People’s Committee
Procedure:
Article 18 of the 2014 Law on civil status stipulates the marriage registration procedures as follows:
- The male and female partners shall submit the marriage registration declaration, made according to a set form to the civil status registration agency and must be both present at the time of marriage registration.
- Immediately after receiving complete papers specified in Clause 1 of this Article, if seeing that the marriage conditions are fully met in accordance with the Law on Marriage and Family, the justice and civil status officer shall record the marriage in the civil status book and together with the male and female partners sign in the civil status book. The male and female partners shall both sign the marriage certificate; the justice and civil status officer shall report to the chairperson of the commune-level People’s Committee to organize the handover of the marriage certificate to the couple.
In case of necessity to verify the marriage conditions of the male and female partners, the time limit for settlement is 5 working days.
