I. Trade Union Law 2024

On the basis of inheriting and developing the contents of the 2012 Trade Union Law, the 2024 Trade Union Law (effective from July 1, 2025) has been amended and supplemented to overcome some remaining limitations and preserve ensuring consistency and synchronization with the current legal system and the 2013 Constitution, thereby meeting the activities of the Trade Union in the new period. 

II. Important changes of the Trade Union Law 2024

1. Clearer regulations on the Vietnamese Trade Union organizational system

Vietnam Trade Union is the only organization representing workers at the national level in labor relations. According to the new regulations in Article 8 of the Trade Union Law 2024, trade unions are clearly divided into 4 levels:

  • The central level is the Vietnam General Confederation of Labor;
  • Provincial, central sector and equivalent trade unions;
  • The direct superior union at the grassroots level
  • Grassroots-level trade unions include grassroots trade unions and grass-roots trade unions.

2. Foreign workers are allowed to join the Trade Union

Compared to the 2012 Trade Union Law, the 2024 Trade Union Law has added regulations on the right to establish, join and operate trade unions for foreign workers. Specifically, employees who are foreign citizens working in Vietnam under a labor contract with a term of 12 months or more are allowed to join and participate in trade union activities at the grassroots trade union. However, foreign workers who join the Union are not allowed to run for office or receive nominations as union officials and can only participate in trade union activities at the grassroots union.

Allowing foreign workers to join unions is an important step in building a fair and developed society. This is also a testament to Vietnam’s efforts in international integration and protecting workers’ rights.

3. Additional rights of supervision and social criticism of the Trade Union

Supervision activities of the Trade Union include participating in supervision with competent state agencies and leading supervision activities. Trade unions have the right and responsibility to contribute opinions and social criticism on draft legal documents, planning, plans, programs, projects and schemes of directly related state agencies. Next comes the rights and interests of trade union members and workers.

4. Additional cases of exemption, reduction, and temporary suspension of union dues payment

The 2024 Trade Union Law has added regulations on cases of exemption, reduction, and temporary suspension of union fee payment. Accordingly, dissolved or bankrupt enterprises and cooperatives whose assets after division do not have enough money to pay union fees will be exempted from that amount. Agencies, organizations, and businesses that encounter difficulties due to economic reasons or force majeure are entitled to a reduction in union dues. In addition, employers who have to temporarily stop production and business and are unable to pay union dues may temporarily stop paying union dues for no more than 12 months. 

5. Clarify the principles of management and use of trade union finance and expenditure tasks of trade union finance.

The 2024 Trade Union Law continues to maintain the union fee payment rate of 2%, along with more detailed regulations on management and use of union finance and amending and supplementing finance tasks. union.
