II. Definition of Legal Aid

Legal aid in Vietnam is a critical activity aimed at ensuring the rights and legitimate interests of citizens, particularly those in difficult circumstances. This initiative facilitates easier access to justice, contributing to the creation of an equitable and democratic society.

Legal aid refers to the provision of free legal services to eligible individuals in legal aid cases, thereby guaranteeing human rights and citizens’ rights to access justice and equality before the law.

III. Legal Aid for Vietnamese Citizens

Vietnamese citizens are eligible for legal aid under the following circumstances:

1. Persons with meritorious services to the revolution.
2. Individuals from poor households.
3. Children.
4. Ethnic minorities residing in areas with particularly difficult socio-economic conditions.
5. Persons accused of criminal offenses aged 16 to under 18.
6. Persons accused of criminal offenses from near-poor households.
7. Individuals facing financial difficulties, including:

• • Biological parents, spouses, children of martyrs, and those who took care of martyrs when they were minors.
  • Victims of Agent Orange.
  • Elderly individuals.
  • Persons with disabilities.
  • Victims aged 16 to under 18 in criminal cases.
  • Victims of domestic violence.
  • Victims of human trafficking.
  • Individuals living with HIV.

IV. Legal Aid for Foreign Nationals

Legal aid is also available to foreign nationals under the following conditions:

• Citizens from countries that have signed mutual judicial assistance agreements with Vietnam are entitled to request legal aid in Vietnam. To date, Vietnam has signed such agreements with over 100 countries globally.
• Citizens from countries without such agreements may contact their consulate in Vietnam to coordinate with the Legal Aid Center under the Department of Justice for assistance.

Foreign nationals requiring legal aid must be accompanied by an interpreter. However, they may request assistance from the Department of Justice to arrange interpretation services or seek support from professional associations or charitable organizations.

Eligible individuals can request legal aid either personally or through relatives, agencies, authorized procedural officers, or other organizations or individuals. They are informed of their rights to legal aid, the procedures, and the steps involved when visiting legal aid organizations or relevant state agencies. Confidentiality regarding their case is maintained. However, they must provide necessary documents to verify their eligibility for legal aid and cooperate by supplying timely and complete information, documents, and evidence related to the case.

To access legal aid, individuals can contact state legal aid centers, law firms, or legal consultancy organizations in their locality.
