VIETNAM TOWARDS ELECTRONIC COURTS FROM 01/01/2025
From 01/01/2025, District 1 Court of Ho Chi Minh City will become the first court in Vietnam to deploy the Electronic Court model (Ecourt), contributing to modernizing the judicial system and reforming procedures. proceedings. This model will help digitize the litigation process and eliminate dependence on paperwork, bringing great benefits to litigants and litigation agencies.
Electronic courts will change the way proceedings are conducted with all activities taking place in the digital space. People and litigation agencies will no longer have to use paperwork during the case resolution process. In particular, litigants will be instructed to open an electronic account through biometric information and can update case information from anywhere.
Up to now, a litigant’s application has been lengthy and laborious to have it accepted because he or she has to go to the Court to check whether the application needs to be supplemented or has been accepted or not, or if you want to meet the secretary or judge, you have to do so. make an appointment or wait. The litigant or the litigant’s proxy will be the manager of his or her account, and they have the right to monitor all activities of the judge in particular and the court in general. With the Ecourt model, litigants just need to log into their account, no matter where they are, and can update information about their lawsuit.
According to the Chief Judge of the District 1 People’s Court, in fact, after the lawsuit was accepted by the court, the litigants were very eager to bring the case to trial, or wanted to know whether the defendant would provide any documents or not. In addition, according to current regulations, if you want to photocopy a document, you must apply to the court to photocopy the document, and then whether or not you can photocopy it depends on the secretary or judge.
But when all proceedings take place in digital space, all documents and case documents are updated on the case account, and litigants have the right to monitor the judge’s activities. At the same time, if you do not agree with the judge’s documents and procedural deadlines for resolving the case, there will be a reflection section in the account for the litigant to report directly to court leaders.

1. Submit documents and evidence remotely
Regarding this issue, the Chief Justice of District 1 People’s Court affirmed that if you want to completely change as above, you need to legislate the regulations. Currently, when the court is implementing an internal information management system, moving towards the Court of Justice, the initial steps may not be complete but always create maximum conditions for litigants.
For example, when a litigant comes to file a lawsuit and open an account, the court will provide a link to submit additional documents and evidence for the court to consider whether it is appropriate or not. At the same time, if the case is accepted, the court will still create a link for the litigant to provide documents and evidence, without having to go to court to submit multiple times.
However, sending documents and evidence to the link in the form of scanned copies or document files is only for reference value, except for documents with digital signatures. In essence, the litigant still has to submit the original copy to the court. The court will still receive this original copy by post to authenticate evidence and keep records. Documents, when authenticated by the court, will be digitized into the data warehouse, and litigants will naturally have the right to access them.
In addition, for civil cases, when the litigant has an account and a database of documents and evidence, the court will still be able to open a public session for documents and evidence, including mediation. online.
2. Software to support litigation and clarify evidence in court
The District 1 People’s Court has currently deployed software to support litigation at civil and criminal trials. This is software built by the People’s Court of District 1, with the function of displaying digitized documents and evidence on a public screen in the courtroom, granting access and sharing rights directly to those who conduct the proceedings, the person participating in the proceedings at the trial.
The advantage of litigation support software is that it runs on tablets, suitable for litigants, lawyers, or people conducting proceedings to interact such as comparing documents, zooming in, zooming out, marking, drawing. on digitized evidence documents prepared by the court clerk or submitted by the parties at the trial if approved by the jury. The court clerk proactively coordinates evidence and documents, avoiding revealing or unintentionally displaying documents that do not need to be announced during the trial. Accordingly, the Lawyer, the Procuracy, and the litigants will argue together visually to clarify the evidence they provide.
In short, Ecourt from 01/01/2025 is an important step forward in modernizing the Vietnamese judicial system. Applying digital technology to litigation not only saves time and costs but also creates a transparent, fair and accessible legal environment for people. Along with that, regulations to submit documents and evidence online and litigation support software will make the trial process more accurate and faster.
