The Government has just issued Decree No. 151/2024/ND-CP detailing a number of articles and measures to implement the Law on Road Traffic Order and Safety. The Decree regulates general conditions for foreign motor vehicles and foreigners participating in traffic in Vietnam.

I. Foreign motor vehicles and foreigners driving vehicles participating in traffic in Vietnam

a) Foreign motor vehicles

– Foreign motor vehicles brought by foreigners to Vietnam for tourism include: passenger cars with right-hand drive or left-hand drive passenger cars with up to 08 seats (not including the driver’s seat). ), mobile housing cars; two-wheeled motorbike.

– Foreigners’ cars with right-hand drive used in traffic in Vietnam for non-tourism purposes are passenger cars.

b) Conditions for foreigners driving vehicles participating in traffic in Vietnam

* Condition shared For foreign motor vehicles and foreigners participating in traffic in Vietnam:

– There is a written approval to be organized for foreigners to bring foreign motor vehicles into traffic in Vietnam;

– Must go through Vietnam’s international travel service business to carry out procedures to request approval for the cases specified in Clause 1 of this Article;

– There must be a note from a diplomatic representative agency, consular agency or representative agency of an intergovernmental international organization in Vietnam requesting and clearly stating the reason for the vehicle to participate in traffic in Vietnam. for the cases specified in Clause 2 of this Article.

* Conditions for foreign motor vehicles participating in traffic in Vietnam:

– Have a vehicle registration certificate and license plate issued by a competent authority of the country where the vehicle is registered and are still valid;

– Have a certificate of technical safety and environmental protection inspection for motor vehicles or equivalent documents issued by a competent authority of the country of vehicle registration that is still valid for cars.

* Conditions for foreigners driving foreign motor vehicles participating in traffic in Vietnam:

– Have a passport, visa or documents valid for international travel, documents valid for residence in Vietnam, except in cases of visa exemption and not in the case of not allowing entry according to the provisions of law. Law on entry, exit, transit, and residence of foreigners in Vietnam.

In case a foreigner enters the country under unilateral visa exemption, the passport must be valid for at least 6 months; Foreigners using electronic visas must enter through international border gates decided by the Government according to the provisions of law on entry, exit, transit, and residence of foreigners in Vietnam;

– Have a driver’s license suitable for the type of vehicle allowed to drive, valid for use within the territory of Vietnam and still valid.

II. Foreigners driving foreign motor vehicles when participating in traffic in Vietnam

1. Foreigners driving foreign motor vehicles when participating in traffic in Vietnam must travel in groups and have a vehicle driver in front to guide them during traffic in Vietnam. The vehicle used for guidance is a car or motorbike suitable for the vehicle used in the group.
2. Be allowed to participate in traffic on routes, road sections and travel times in the territory of Vietnam according to the written approval of the competent authority.
3. When driving foreign motor vehicles in traffic, foreigners must strictly comply with the provisions of law on road traffic order and safety of Vietnam; Bring and present the following documents when requested by competent authorities:
4. a) Passport or documents valid for international travel, documents related to residence in Vietnam;
5. b) Driver’s license suitable for the type of vehicle allowed to drive, valid for use within the territory of Vietnam and still valid;
6. c) Certificate of technical safety and environmental protection inspection for motor vehicles or equivalent documents issued by a competent authority of the country of vehicle registration that is still valid (for cars);
7. d) Vehicle registration certificate issued by the competent authority of the country of vehicle registration and still valid;
8. d) Civil liability insurance certificate of motor vehicle owner valid in Vietnam;
9. e) Customs declaration of road transport vehicles temporarily imported for re-export.

Thus, when foreigners drive foreign vehicles in Vietnam, they need to clearly understand the above regulations to avoid violating Vietnamese law.
