REGULATIONS ON ISSUANCE OF TEMPORARY RESIDENCE CARD FOR FOREIGNERS IN VIETNAM

II. Regulations on issuance of temporary residence card for foreigners in Vietnam

1. What is a temporary residence card?

Law Entry, exit, transit, and residence of foreigners in Vietnam 2014 regulations: “Temporary residence card is a document issued by the immigration management agency or a competent agency of the Ministry of Foreign Affairs to foreigners who are allowed to reside for a period of time in Vietnam and is valid in lieu of a visa.”

Accordingly, temporary residence card for foreigners in Vietnam is a document issued by Vietnam’s immigration management agency to qualified foreigners. This card allows foreigners to legally reside in Vietnam for a certain period of time without having to renew their visa multiple times. This is a convenient and cost-effective solution for foreigners who plan to live and work long-term in Vietnam.

When foreigners use temporary residence cards to reside and live in Vietnam, foreigners need to pay attention to the following issues:

3. Conditions for granting temporary residence card

To be granted a temporary residence card in Vietnam, foreigners need to meet the following conditions:

  • Have a valid passport;
  • Have a suitable visa: Foreigners must enter Vietnam with a visa for the correct purpose (such as a work, investment, or visit visa).
  • Have a guarantee agency/organization or individual: Foreigners need to be sponsored by a company, organization, or individual in Vietnam.
  • Legal eligibility: Person nForeign countries are not prohibited from entering or residing in Vietnam according to regulations on immigration for foreigners.

4. How long is the temporary residence card for foreigners?

Expiry date of the card temporary Residence depends on the purpose of residence and the corresponding visa type, specifically as follows:

  • The duration of the temporary residence card issued is at least 30 days shorter than the remaining validity of the passport.
  • The temporary residence card with the symbol ĐT1 is valid for no more than 10 years.
  • Temporary residence cards with symbols NG3, LV1, LV2, LS, DT2 and DH are valid for no more than 5 years.
  • Temporary residence cards with symbols NN1, NN2, DT3, TT are valid for no more than 03 years.
  • Temporary residence cards with symbols LD1, LD2 and PV1 are valid for no more than 02 years.
  • Expired temporary residence cards will be considered for issuance of new cards.

Regulations on penalties for foreigners using expired temporary residence cards are as follows: 

  • Foreigners who use temporary residence certificates, temporary residence extensions, temporary residence cards, or do not renew permanent residence cards in Vietnam for a period of less than 16 days without permission from a competent authority will be fined from 500,000 VND to 2,000,000 VND.
  • Foreigners who use temporary residence certificates, temporary residence extensions, temporary residence cards, or do not renew permanent residence cards in Vietnam for more than 16 days to less than 30 days without permission from the competent authority will be subject to the penalty. fined from 3,000,000 VND to 5,000,000 VND.
  • Foreigners who use temporary residence certificates, temporary residence extensions, temporary residence cards, or do not renew permanent residence cards in Vietnam for more than 30 days to less than 60 days without permission from the competent authority will be subject to the penalty. fined 5,000,000 VND to 10,000,000 VND.
  • Foreigners who use temporary residence certificates, temporary residence extensions, temporary residence cards, or do not renew permanent residence cards in Vietnam for more than 60 days to less than 90 days without permission from the competent authority will be subject to the penalty. fined 10,000,000 VND to 15,000,000 VND
  • Foreigners who use temporary residence certificates, temporary residence extensions, temporary residence cards, or do not renew permanent residence cards for more than 90 days or more without permission from the competent authority will be fined from 15,000 VND. 000 VND to 20,000,000 VND.
